  1. The Parties to this agreement are Kathleen Brenner, of Brighton Victoria, an ICF member and Accredited Associate Coach (the Coach) and the purchaser of this coaching package (the Coachee). 
  2. The Coach agrees to provide the Coaching Services described on the purchase page of this package. 
  3. Coaching is a partnership (defined as an alliance, not a legal business partnership) between the Coach and the Coachee in a thought-provoking and creative process that inspires the Coachee to maximise personal and professional potential. It is designed to facilitate the creation/development of personal, professional or business goals and to develop and carry out a strategy/plan for achieving those goals.
  4. The Coach agrees to maintain the ethics and standards of behaviour established by the International Coaching Federation “(ICF)” (Coachfederation.org/ethics). It is recommended that the Coachee review the ICF Code of Ethics and the applicable standards of behaviour.
  5. The Coachee is solely responsible for creating and implementing his/her/their own physical, mental and emotional well-being, decisions, choices, actions and results arising out of or resulting from the coaching relationship and his/her/their coaching calls and interactions with the Coach. As such, the Coachee agrees that the Coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by the Coach. Coachee understands coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.
  6. The Coachee acknowledges that coaching is a comprehensive process that may involve different areas of his/her/their life, including work, finances, health, relationships, education and recreation. The Coachee agrees that deciding how to handle these issues, incorporate coaching principles into those areas and implementing choices is exclusively the Coachee's responsibility.
  7. The Coachee acknowledges that he/she/they may terminate or discontinue the coaching relationship at any time.
  8. The Coachee acknowledges that coaching does not involve the diagnosis or treatment of mental disorders as defined by the American Psychiatric Association and that coaching is not to be used as a substitute for counselling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical or other qualified professionals and that it is the Coachee's exclusive responsibility to seek such independent professional guidance as needed. If the Coachee is currently under the care of a mental health professional, it is recommended that the Coachee promptly inform the mental health care provider of the nature and extent of the coaching relationship agreed  upon by the Coachee and the Coach.
  9. The Coachee understands that in order to enhance the coaching relationship, the Coachee agrees to communicate honestly, be open to feedback and assistance and to create the t time and energy to participate fully in the program.
  10. The Coachee may call the Coach between 9am and 9pm for the on-demand 15 minute coaching sessions and if the Coach is unavailable, the Coach will return the Coachee's call with 24 hours.
  11. The Coaching Agreement is valid from the date of execution and remains in force until the completion of the 6 coaching sessions, as specified in the Program Description. Unless otherwise agreed to by the parties, the sessions must be completed within 6 months of purchase. 
  12. The refund policy is as follows:
  • The Coachee agrees to give the coach at least 48 hours notice of the cancellation of a session. In the event of sudden illness or emergency, the Coachee agrees to give the Coach notice as soon as possible; and
  • The failure to give notice will result in the forfeiture of the session; and
  • No refunds will be provided following completion of the sessions. 
  1. The time for the coaching meetings will be determined by the Coach and Coachee based on a mutually agreed upon time. Unless otherwise agreed, the Coachee will book each session using the scheduling function in Kajabi. Unless, otherwise agreed, each coaching meeting will take place within the Kajabi platform. 
  2. This coaching relationship, as well as all information (documented or verbal) that the Coachee shares with the Coach as part of this relationship, is bound by the principles of confidentiality set forth in the ICF Code of Ethics. However, please be aware that the Coach-Coachee relationship is not considered a legally confidential relationship (unlike the medical and legal professions) and thus communications are not subject to the protection of any legally recognised privilege. To the extent permitted by law, the Coach agrees not to disclose any information relating to the Coachee without the Coachee’s written consent. The Coach will not disclose the Coachee’s name as a reference without the Coachee’s consent. Confidential Information does not include information that: (a) was in the Coach’s possession prior to its being provided by the Coachee; (b) is generally known to the public or in the Coachee’s industry; (c) is obtained by the Coach from a third party, without breach of any obligation to the Coachee; (d) is independently developed by the Coach without use of or reference to the Coachee’s confidential information; or (e) the Coach is required by law to disclose; (f) is disclosed to the Coach and as a result of such disclosure the Coach reasonably believes there to be an imminent or likely risk of danger or harm to the Coachee or others; and (g) involves illegal activity. The Coachee also acknowledges his or her continuing obligation to raise any confidentiality questions or concerns with the Coach in a timely manner.
  3. The Coach engages in training and continuing education pursuing and/or maintaining ICF (International Coach Federation) Credentials. That process requires the names and contact information of all Coachees for possible verification by ICF. By signing this agreement, you agree to have only your name, contact information and start and end dates of coaching shared with ICF staff members and/or other parties involved in this process for the sole and necessary purpose of verifying the coaching relationship, no personal notes will be shared.
  4. According to the ethics of our profession, topics may be anonymously and hypothetically shared with other coaching professionals for training, supervision, mentoring, evaluation, and for coach professional development and/or consultation purposes.
  5. Personal Information and confidential information collected by the Coach in the course of the coaching relationship may be retained by the Coach for no less than 1 year. Records collected may include handwritten notes which will be stored securely on the Coach’s premises. Personal information and/or confidential information may also be sent to the Coachee via email and retained on the Coach’s email (gmail) and computer (accessible only by password). Personal Information will only be used for coaching purposes and will not be disclosed to third parties except as required by law or in accordance with this Agreement. Personal Information means information or an opinion about an identified individual, or an individual who is reasonably identifiable: (a) whether the information or opinion is true or not; and (b) whether the information or opinion is recorded in a material form or not.
  6. Either the Coachee or the Coach may terminate this Agreement at any time with 2 weeks written notice. Coachee agrees to compensate the Coach for all coaching services rendered through and including the effective date of termination of the coaching relationship.
  7. Except as expressly provided in this Agreement, the Coach makes no guarantees, representations or warranties of any kind or nature, express or implied with respect to the coaching services negotiated, agreed upon and rendered. In no event shall the Coach be liable to the Coachee for any indirect, consequential or special damages. Notwithstanding any damages that the Coachee may incur, the Coach’s entire liability under this Agreement, and the Coachee’s exclusive remedy, shall be limited to the amount actually paid by the Coachee to the Coach under this Agreement for all coaching services rendered through and including the termination date.
  8. This document reflects the entire agreement between the Coach and the Coachee and reflects a complete understanding of the parties with respect to the subject matter. This Agreement supersedes all prior written and oral representations. The Agreement may not be amended, altered or supplemented except in writing signed by both the Coach and the Coachee.
  9. This agreement is subject to the laws of the state of Victoria and Australia. If there is a dispute between the Coach and the Coachee that results in litigation then you must submit to the jurisdiction of the courts of Victoria, Australia.
  10. By purchasing this coaching package, you agree to the terms and conditions of this Service Agreement.
